Joia, Jr. and Darlene E. Joia <br /> requesting a Variance under Article VII§174-31 (Land Space Requirements)of the Zoning <br /> By-laws to vary the front and side setback requirements to locate a shed in an R-5 Zoning <br /> District at 49 Somerset Road, (Map 16 Parcel 11), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Tow.of Mashpee,on September 6,2013 and September 13,2013 <br /> a copy of which is attached hereto and made a part hereof. <br /> On September 25, 2013 Public Hearings were held on this Petition at the Mashpee <br /> Town Hall at which time the following Board Members were present, Chairman, Jonathan <br /> D. Furbush, Vice Chairman, William A. Blaisdell, Clerk,Ronald S. Bonvie and Associate <br /> Member, Domingo K. DeBarros. Also present was Building Commissioner, Richard <br /> Morgan. The Petition was continued until October 9, 2013 Hearings. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provision of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Joia represented himself seeking a variance for his shed to be moved within 3.3 <br /> feet of the sideline. He stated his property extends around a circle and has 55 feet to the <br /> front corner where he would like to place the shed. His lot is on a cul-de-sac and the radius <br /> encompasses the road in. front of his house and makes it very difficult to meet the front <br /> setback. He stated he is seeking relief of the front. <br /> The Board requested an updated engineered stamped plot plan to depict the shed <br /> closer to the house. Mr. Joia did not consult with an engineer and asked for a continuance <br /> until the next hearing dated October 23, 2013. The Board continued the hearing pending <br /> an updated plot plan from a certified engineer and requires a decision at the next hearing. <br /> 1 <br />
