• <br />r� <br />J <br />`I"own. of Mashpee <br />16 Great.Neck'ltoad <br />blashpee, Massachusetts <br />MASHPEE ZONING BOARD OF APPEALS <br />SEPTEMBER 25, 2013 <br />.MINUTES <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, September <br />25, 2013, at 6:00 p.m. in the Ockway Conference Room at the Mashpee Town Hall, 16 <br />Great Neck Road North. Present were Board Members, Jonathan D. Furbush, William A. <br />Blaisdell, Ronald S. Bonvie, and Associate Member, Domingo K. DeBarros. Also present <br />was Building Commissioner, Richard E. Morgan. Board Member James Reiffarth and <br />Associate Member Richard Jodka were absent. <br />Jonathan Furbush opened the meeting at 6:00 pm and announced that Board Member, John <br />Dorsey retired from the Zoning Board of Appeals. Sitting on this hearings are the three <br />regular Board Members and Dom DeBarros, Associate Member. Board Members Jim <br />Reiffarth and Richard Jodka were absent and one member retired. There are normally seven <br />members. Every petitioner is entitled to have five zoning members present. As with every <br />petition to pass there must be four positive votes. When all five members are present you <br />can have four positive votes and one negative vote, and the petition can pass. But with only <br />four members, all four must vote positive to pass. He also stated the Board can grant a <br />continuance to the petitioner until the next meeting. <br />Arthur R. and Darlene E. Joia: Request a Written Finding under Article V §174-17 of <br />the Zoning By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension or <br />alteration of pre-existing, non -conforming structure to relocate a shed on property located <br />in an R-5 Zoning District at 49 Somerset Road, (Map 16 Parcel 11), Mashpee, MA. <br />Arthur R. and Darlene E. Joia: Request a Variance under Article VII §174-31 (Land <br />Space Requirements) of the Zoning By-laws to vary the rear and side setback requirements <br />to relocate a shed located in an R-5 Zoning District at 49 Somerset Road, (Map 16 Parcel <br />11), Mashpee, MA. <br />Mr. Joia stated he is seeking a Variance for the front and side setback rather than the rear <br />and side setback. The plot plan shows he has a non -conforming lot and his property is on <br />a cul-de-sac called Somerset Road. The left side property is a "paper road" called Tobeys <br />Back Road and is a dirt wooded road. There are seven homes in this area, and the back of <br />the lot is narrow and triangular shaped and abuts conservation land along the left side. He <br />stated he was granted a variance at a meeting back in 1995 to move his garage, and is <br />requesting the same relief of 3 foot 3 inches for his shed. He purchased the shed fully <br />assembled to store his yard tools and lawn mower. The shed is 10 feet by 18 feet (180 <br />square feet) and is currently stored on top a trailer. <br />
