Town of A* Tashpee <br />J <br />16 Great .heck Rtoad ✓forth <br />mashpee, Massachusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />OCTOBER 9, 2013 <br />MINUTES <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, October 9, <br />2013, at 6:00 p.m. in the Waquoit Conference Room at the Mashpee Town Hall, 16 Great <br />Neck Road North. Present were Board Members, Jonathan D. Furbush, William A. <br />Blaisdell, James Reiffarth, Richard Jodka and Associate Member, Domingo K. DeBarros. <br />Also present was Building Commissioner, Richard E. Morgan. Board Member Ronald <br />Bonvie was absent. <br />Jonathan Furbush opened the meeting at 6:00 pm and announced the meeting was being <br />televised live on local Mashpee television. He announced Richard Jodka was appointed a <br />Full Board Member replacing Jack Dorsey who retired from the Zoning Board of Appeals. <br />PLEDGE OF ALLEGIANCE <br />CONTINUED HEARING <br />• Arthur R. and Darlene E. Joia: Request a Variance under Article VII §174-31 (Land <br />Space Requirements) of the Zoning By-laws to vary the rear and side setback requirements <br />to locate a shed in an R-5 Zoning District at 49 Somerset Road, (Map 16 Parcel 11), <br />Mashpee, MA. (Continued from September 25, 2013 hearings). <br />Arthur Joia represented himself stated there was a misprint regarding his request for relief. <br />He is seeking a variance for the front and side setback rather than the rear. He stated he <br />received a variance for his garage and moved it within 3.3 feet of the sideline and is asking <br />for the same variance for his shed. He stated his property extends around a circle and has <br />55 feet to the front comer where he would like to place the shed. His lot is on a cul-de-sac <br />and the radius encompasses the road in front of his house and makes it very difficult to <br />meet the front setback. He stated he is seeking relief of the front. <br />Mr. Morgan mentioned to Mr. Joia that an updated engineered stamped plot plan should <br />depict the shed closer to the house. Mr. Joia did not consult with an engineer and asked for <br />a continuance until the next hearing dated October 23, 2013. The Board continued the <br />hearing pending an updated plot plan from a certified engineer and requires a decision by <br />October 25, 2013. <br />Mr. Blaisdell made a motion to continue Arthur R. and Darlene E. Joia request for a <br />Variance under Article VII § 174-31 (Land Space Requirements) of the Zoning By-laws to <br />vary the rear and side setback requirements to locate a shed in an R-5 Zoning District at 49 <br />• Somerset Road, (Map 16 Parcel 11), Mashpee, MA, which has been continued from <br />September 25, 2013, to tonight and will continue until October 23, 2013. Mr. Jodka, <br />second, Votes: Mr. Furbush, yes, Mr. Reiffarth, yes, Mr. DeBarros, yes. All were in favor. <br />1 <br />
