MASHPEE ZONING BOARD OF APPEALS <br />OCTOBER 9, 2013 <br />MINUTES <br />Vice Chairman, Mr. Blaisdell read letters submitted to the Board by abutters that reside at <br />70 Punkhom Point Road, 77 Punkhorn Point Road, 79 Punkhom Point Road, 85 Punkhom <br />Point Road and 89 Punkhom Point Road that were in favor of the proposed project. <br />Several abutters and representatives of the Mashpee Wampanoag Tribe were present and <br />addressed the Board and spoke in opposition. Jessie (Little Doe) Baird, Vice Chairman of <br />the Mashpee Wampanoag Tribe stated her concerns the applicant had no regard for <br />conditions of the Island or the shellfish grant. Attorney Charles Savon, representing his <br />client that resides at 84 Punkhom Point Road opposed stating this variance is a "self- <br />imposed" hardship and does not qualify under case law as a hardship and inconsistent with <br />the bylaw of a lot fronting a street. Tribal Chairman, Cedric Cromwell approached the <br />Board stating he is strongly against the proposal, besides safety and health is environment <br />concerns for Popponesset Bay. John Weltman, of 80 Punkhorn Point Road spoke in <br />opposition regarding safety issues. George Green, Assistant Director of the Natural <br />Resource Department for the Tribe is opposed to the project and described the detail of the <br />shellfish grant and anticipating to reach the 90% TMDL benchmark lowering sewer costs <br />for the Town. <br />Mr. William Blaisdell, voted against the application, Mr. James Reiffarth voted against, <br />• Mr. Richard Jodka voted in favor, Mr. Dom DeBarros voted against and Mr. Jonathan <br />Furbush voted against. <br />TCB Mashpee Village LP: Request a modification to the 1974 Special Permit under <br />§174-24(C) 9 (a) (b) of the Zoning By-laws and M.G.L. Chapter 40A §6 to allow for <br />construction of a single additional accessory building on property located in an R-5 Zoning <br />District at One Wampanoag Drive, (Map 66 Parcel 1-0-R), Mashpee, MA. <br />Attorney Stephanie Kiefer stated she represents TCB Mashpee Village, and also present is <br />Greg Pierce, Engineer, Kevin Olsen and Jim Perrine, Representative of TCB. Stephanie <br />stated the request is for a minor modification as part of a Special Permit that was granted <br />to Cape Cod United Church dated 1974. Prior to submission of the materials, she met with <br />Mr. Morgan and reviewed the project and the proper procedure to present the project to the <br />Zoning Board of Appeals. <br />Stephanie stated the project falls under the Special Permit, a cluster residential <br />development , as well as apartment buildings with certain areas set aside for open space <br />under the 1973 Bylaw Section 9.3. Presently the site is served by a mix of seven (7) Title <br />5 septic units, garden -style apartments, and multi -family units, as well as common septic <br />systems for the homes on Amos Circle. The applicant wants to centralize the septic system <br />to improve both ground water quality and treatment of the wastewater throughout the <br />development. This enhanced treatment system will include a 36' x 44' structure to house <br />the pumps and blowers and will be consistent with the architectural style of the <br />development. <br />E <br />
