S <br /> Board of Selectmen <br /> Minutes <br /> January 2 , 2004 <br /> OLD BUSINESS: <br /> Memorandum from Fire Department re; Finally Dino <br /> Selectman Leveille stepped down for the above referenced agenda topic of <br /> discussion. Selectmen Green presided. <br /> Correspondence was received from the Deputy Fire Chief dated January 8, <br /> 2004 relative to the inspection of Finally Dins. It was noted that the <br /> Deputy conducted a site inspection with the Building Inspector. The <br /> furniture was deemed compliant with the requirement of the MA fire code <br /> for upholstered furniture. <br /> It was suggested that the Board consider suspending the entertainment <br /> license of the establishment for one day due to non-compliance. A brief <br /> discussion followed. <br /> Motion made by Selectman Marsters to accept the recommendation of <br /> the Deputy Fire Chief that certifies the compliance of Finally Dino's. <br /> letter of reprimand was agreed to be retained on file. Upon review <br /> in one-year, if the establishment maintains compliance,the letter <br /> would be removed from file. <br /> Motion seconded by Selectman Taylor. <br /> VOTE: Unanimous. -0. <br /> Selectman I,evellle absent. <br /> APPOINTMENTS TS AND DEAIRNGS; <br /> Public Hearing.—Request_ for Transfer of License—The Flume: <br /> Selectman Reveille and Selectman Taylor stepped down for the above <br /> referenced Dearing. Selectman Green presided and opened the Public <br /> Dearing on the application of McNulty Management, Inc., d b a The <br /> Flume, Kenneth S. McNulty, Manager for a Transfer of Liquor License <br /> from The Flume, Inc., dba The Flume, Earle D. Mills, Sr., Tanager. <br /> Joyce Mason, Town Administrator read aloud the Public Dearing notice as <br /> published. It was noted that all necessary paperwork is in order for the <br /> Selectmen's approval. Kenneth McNulty, Manager was in attendance <br /> with his counsel, Theodore Schilling. <br />
