Town of Mashpee <br />s <br />76 Great d\reek 9toad ,/\corth <br />hlmhpee, h1assachusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />DECEMBER 11, 2013 <br />MINUTES <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, December <br />11, 2013, at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck <br />Road North. Board Members Jonathan D. Furbush, William A. Blaisdell, Associate <br />Members Domingo K. DeBarros and Scott Goldstein were present. Building <br />Commissioner Richard E. Morgan was also present. Board Members Ronald Bonvie, <br />James Reiffarth and Richard Jodka were not present. <br />Chairman Jonathan D. Furbush opened the meeting at 6:00 p.m. He announced that the <br />meeting was being televised live on local Mashpee television. There are normally seven <br />members. Every petitioner is entitled to have five zoning members present. As with every <br />petition to pass there must be four positive votes. When all five members are present you <br />can have four positive votes and one negative vote, and the petition can pass. But with only <br />four members, all four must vote positive to pass. He also stated the Board can grant a <br />continuance to the petitioner until the next meeting. <br />• NEW HEARINGS <br />• <br />Akram E. and Marta O. Rafla: Request a Written Finding under §174-17 of the Zoning <br />By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension or alteration of a <br />pre-existing, non -conforming structure to allow for a new second floor addition on property <br />located in an R3 Zoning District at 45 Little Neck Lane, (Map 115 Parcel 15), Mashpee, <br />MA. Withdrawn without prejudice. <br />Mr. Furbush made a motion to accept the withdrawal, Mr. Blaisdell second, Mr. DeBarros, <br />yes, and Mr. Goldstein, yes. All were in favor. <br />Katharine F. and Brown Linsamfelter: Request a Written Finding under § 174-17, and <br />Variance(s) under § 174-31 and § 174-33 of the Zoning By-laws to vary the setback at least <br />fifty (50') feet from any water or wetland as defined by MGL C. 131, §40 for construction <br />of a 35 foot by 60 foot boathouse with two bedrooms on property located in an R-3 Zoning <br />District at 65 Seconsett Point Road, (Map 124 Parcel 14-0-R), Mashpee, MA. <br />Attorney, Brian Wall submitted formal requests to continue until January 22, 2014. Mr. <br />Furbush made a motion to accept the continuance, Mr. Blaisdell, second, Mr. DeBarros, <br />yes, and Mr. Goldstein, yes. All were in favor. <br />1 <br />
