MASHPEE ZONING BOARD OF APPEALS <br />DECEMBER 11, 2013 <br />MINUTES <br />Attorney, Kevin Kirrane requested a continuance until January 8, 2014 hearings, with a <br />full member board. <br />Mr. Furbush, made a motion to accept the continuance, Mr. Blaisdell second, Mr. <br />DeBarros, yes, and Mr. Goldstein, yes. All were in favor. <br />Kevin and Christine Granfreld: Request a Written Finding under §174-17 and §174-20 <br />of the Zoning By-laws and M.G.L. Chapter 40A §6 concerning alteration of a pre-existing, <br />destroyed or damaged non -conforming structure to raze and replace a garage on property <br />located in an R3 Zoning District at 40 Bayview Road, (Map 119 Parcel 48), Mashpee, MA. <br />Steve Cook, Cotuit Bay Design representing the Petitioners at 40 Bayview Road. The <br />Granfield's own an existing garage and storage building on the property. The garage is old <br />and dilapidated that dates back to the 1940's. They are requesting to tear down the rear <br />section of the garage. The cross section is concrete block and no footings, two car garage <br />with a truss roof system on the rear section. It's a pre-existing, non -conforming structure. <br />The proposal is to build a game room area on the first floor behind the garage with a <br />bathroom, and stairway to a second floor loft. It's currently a one story structure and will <br />become a story and a -half The footprint is pulled back 9 inches from the rear side, with a <br />• 100 foot buffer zone from the top of the coastal bank. The greenhouse will be torn down <br />and that footprint will become a screened porch. <br />17� <br />Mr. Furbush read the Board of Health comment, dated December 4, 2013; "The game room <br />is not considered a bedroom because it has no privacy. There are doorways from the garage, <br />side and rear. Steve Cook said that you cannot enter into a bedroom through the garage. <br />The loft space above is open to below with an open stairway so that is not considered to <br />have privacy. If the ZBA wishes to restrict the structure with a deed restriction, I would <br />support that. The septic is only built for three bedrooms." <br />The existing lot coverage is 25%, and proposed 24.9%. The structure will be 4.5 feet close <br />to the lot line. <br />Mr. Blaisdell made a motion to approve Kevin and Christine Granfield, request for a <br />Written Finding under §174-17 of the Zoning By-laws and M.G.L. Chapter 40A §6 <br />concerning continuance, extension or alteration of a pre-existing, non -conforming structure <br />to raze and replace a garage on property located in an R3 Zoning District at 40 Bayview <br />Road, (Map 119 Parcel 48), Mashpee, MA. <br />Mr. Furbush, second, Mr. DeBarros, yes, and Mr. Goldstein, yes.
