As Planning Board Member Joseph Mullin was not present at the previous <br /> rneetmg he signed the Reconsideration ]decision and Special Permit Modification <br /> ication <br /> documents with regard to Ilashpee Investors LLC, South:Cape Tillage.Shopping Center. <br /> The Chairman, Thomas O'Hara, signed the Form ICI document. <br /> Public Hearing <br /> -Zoning,Articles Proposed by Petition for the May 201 o Town Meeting <br /> Amendment to Section 1 4-2 .I to Allow Parking of School Bus by light ire Any Zone <br /> Amendment to Zoning Map to Change Map 62, Block 68B from R-3 to C- ' omm.ercial <br /> The appointed hour having arrived the Chairman read the Public Hearing:notice <br /> into the record and called the Public Hearing to order. <br /> The Town Planner explained that the current bylaw allows for the parking of one <br /> (1) commercial vehicle per lot, 2-ton capacity. <br /> The Cham' nan recognized Petitioners Jill Allen and Evelyn Peters. <br /> GIs. Allen suggested that a school bus is not,a commercial vehicle, as it is <br /> associated with.the school system and is only involved in school related activities. <br /> Currently, there are-sixteen 16 (large-capacity) school bus routes in the Town of <br /> iashpee. Of said 16-routes, eight to ten drivers live outside of town. Currently there are <br /> only four 4 school bus drivers who live in 1rlahpee and who would take their busses <br /> home to be parted overnight. <br /> The only days busses would be parked ovemight(generally) are Tuesday- <br /> Wednesday, and Thursday; not over the weekend. Drivers would park the busses <br /> between 4: o and : o p.m. at the latest. Most drivers would prefer to back in off the <br /> street, so the backup alarm would not be heard in the morning hours when they leave. <br /> The bus company allows the drivers fifteen-minutes in the morning-to complete.a circle <br /> check, which includes an inspection under the hood (belts, Wires, fluids), inside lights, <br /> start-up, gages, headlights, and back-up alarm. <br /> Ms. Allen made reference to Massachusetts Bylaw—Mass.Ch p. o Section 16 a <br /> and DEP Regulations 3 10 CIS 7.11 1-B Air Pollution Control Regulations,which limits <br /> one 1 vehicle to 'Idle.not more than five (5)-mm'utes in most cases). "A vehicle may <br /> idle longer only if absolutely necessary. There are exceptions for vehicles being <br /> serviced, vehicles making deliveries that need to keep their engiunes running in order to <br /> poorer refrigeration units, for example. Any vehicle-that needs to run to generate-and <br /> operate accessories such as power lifts, which would allow wheelchair access." Local <br /> Board of Health, local Police, State and-Federal Officials are authorized to enforce the <br /> Mate Anti-Idling Law. <br /> Ms. Allen stated that (generally)the school Musses do not ran for more than five <br /> (5)-minutes when the circle check is being done. She argued the conveniences that most <br /> of the bus driver routes are in their area which sages time as well as fuel and wear/tear on <br />
