Review Committees. Approval has been recommended subject to the name change and <br /> consideration of an increase to the buffer area-of the abutting property. Applicant has <br /> met with the-abutters and as a result some changes have been agreed upon and are <br /> reflected on.the proposed revised plan. The original 2 -f . setback has been increased to <br /> - t., the landscaped buffer area has also been.improved and indicated on the plan which <br /> identifies a variety of buffer plantings to enhance the buffer area. Applicant has agreed to <br /> install a fence and enhance the buffer prior to any construction. <br /> Reference was made to comments submitted by Ilrlr. Rowley. Attorney <br /> McElhinney stated that any concerns would be addressed during the appeal period. He <br /> requested that the Public Nearing,be closed this evening, as well as a vote by the Board. <br /> Bennis Balzarini inquired as to possible disturbance of the buffer planting in the <br /> event the fence would need repair/replacement in the future. <br /> Attorney Mc lhinney explained that the plantings are located on the abutter's side <br /> of the property; them will be a screen and then the fence. The plantings are within the 10 <br /> to l -f . range, they will ra t be towering trees. <br /> References were made to a Plan oftand entitled, "Plant List—Privacy Buffer <br /> ' illowbend'Circle' Dated April 1 7, 2010, by Baxter Nye Engineering& Surveying". <br /> At this point Joe Mullin commented that he feels this-is a fine plan and that h <br /> would wholeheartedly support the proposal. <br /> The Chairman then provided the abutters an opportunity to comment, recognizing <br /> the following: <br /> Paul Sparks—Informed the Board that there.had been a meeting the previous <br /> evening at the willowbend heal Estate Office and that he is satisfied with the offers <br /> brought forward by the Applicant. <br /> Carol Souza—Requested a copy-of the most recent revis d plan; to which the <br /> Applicant agreed. <br /> The T wn. lann r relayed a comment made by the Chairman of the Zoning <br /> Board of Appeals with regard to the fact that the owners of Lot 1 and Lot 2 cannot access <br /> l 0-ft. strip of their property duc to the location of the fence and feels that this could <br /> prove to be problematic. <br /> Mr. Rowley suggested the building envelope be shown on the Definitive <br /> Subdivision plan, including the -ff. setback for recording purposes; to which the Board <br /> agreed. <br /> The Town Planner suggested a deed restriction be incorporated into the formal <br /> Decision document as well. He further suggested the Public Dearing remain open until <br />
