Also, Town Counsel has advised that signatures <br /> of those Board Members who will no longer be on the Board after May 5,b, can sign the <br /> plan after such date, as a ministerial act. <br /> Mr. Fowler made reference to two points on the plan that are not in compliance <br /> with the rules and regulations. The sewer easement that parallels Quinaquisset Avenue i <br /> shown as being I 0-ft. wide (the area outside of the drainage easement),the rules and <br /> regulations require a drum of 20-ff. for a.sewer easement. Also, the rubs and <br /> regulations require that test pits be done on the property; to date no testing has been done. <br /> There is an explanation in Mr. Bowlegs report to the Board. Applicant has requested a <br /> waiver, in writing, which Mr. Rowley does not favor. <br /> Mr. l owle is eoncern is that the closest test pits are 1 o-ft. from the closest <br /> stone ater management area; and also that this is a reconstruction project and that the <br /> existing drainage area very near an existing dwelling and is approximately 400- t. from <br /> the closest test pit. Both series of-test pits on the adjacent proper' were conducted 14 <br /> and -years ago. .-feels strongly that new testing should be done and could easily be <br /> accomplished dining the appeal period. <br /> Both the Planning Board and the Applicant agreed that it is important that the soil <br /> testing be done as this is important information. The Applicant then withdrew the request <br /> for waiver of the soil testing regulation. <br /> The flown Planner noted that he would include this condition in the Draft <br /> Decision for completion prior to the signature of the Special Permit. <br /> The only outstanding issue is Mr. o ley's request for a -f . wide sewer <br /> easement for utility construction, as well as-any repair that may need to be done without <br /> encroaching on the abutter's property not encumbered by the easement. He feels there <br /> will be no detriment to the lot to provide a 20-ff. width rather than the proposed I 0-ft. <br /> Attorney McElhinney also agreed to revise the recordable Definitive a flan sheet to <br /> indicate the connection with the willowbend Special Permit indicating that the lots are <br /> smaller than what is required within the zoning standard. <br /> Mr. Rowley stated that the m j onty of concerns have been satisfactorily <br /> addressed. The stormter calculation.issues are minor and should be able to be <br /> addressed. He has requested that Applicant's field engineer verify the field information <br /> as shown on the existing Conditions Plan, as it was prepared by someone else and the <br /> entire design is based upon this information. <br /> Steve Mattson agreed to speak to the surveyors and ask them to verify that the <br /> information shown on the plan is is fact the current conditions of the construction site. A <br /> Dote wi,ll be added to the plan indicating that a field-survey was conducted and <br /> verification made. <br />
