Registry of Deeds Title Reference: <br /> 69 Shoestring Bay Road Book: 7758 Page: 180 <br /> Mashpee, MA 02649 <br /> Map 77 Parcel 137 <br /> A Petition was filed on March 29, 2012 by Willowbend Country Club, Inc. <br /> requesting a Variance from Section 174-31 of the Zoning By-laws to vary the land space <br /> requirements to allow for construction of a single-family dwelling on property located in <br /> an R-3 zoning district at 69 Shoestring Bay Road (Map 77 Parcel 137) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 6, and April 13, 2012 <br /> a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on April 25, <br /> 2012. The following members of the Board were present and acting throughout: Board <br /> Members Jonathan D. Furbush, William A. Blaisdell, and James Reiffarth and Associate <br /> Members John M. Dorsey and Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Attorney Jack McElhinney represented the Petition and stated that in 1998, this <br /> parcel was one of dozens acquired by the Petitioner scheduled to be built in 1999. <br /> Because of the golf course modification, the Cape Cod Commission required the <br /> Petitioner to preserve a portion of the land. Variance relief is required to allow for <br /> construction of a single-family dwelling on this parcel. The Variance previously granted <br /> on this parcel will expire soon. No changes have been made to the original proposal. <br /> Attorney McElhinny thanked the Board for being so flexible and helpful through the <br /> real estate crisis. The current owner of Willowbend Country Club, Inc., has entered into <br /> an agreement to sell the Club along with the remaining unsold real estate to Southworth <br /> Development. Attorney McElhinney that the potential buyer wants assurance that the <br /> necessary approvals are in place before proceeding with the purchase. <br /> No comments were received from abutters. <br /> t <br />
