MASHPEE ZONING BOARD OF APPEALS <br /> Willowbend Country Club, Inc. <br /> 69 Shoestring Bay Road <br /> Mashpee, MA 02649 <br /> V-2012-23 <br /> General Findings <br /> The subject property is located at 69 Shoestring Bay Road and consists of 1.12 acres of <br /> land. <br /> Specific Findings: <br /> 1) The Board determined that a literal enforcement of the provisions of the By-laws <br /> would involve substantial hardship, financial or otherwise, to the Petitioner due to <br /> the following: <br /> • the unique soil conditions with the presence of 8,380 square feet of <br /> wetlands on the parcel. <br /> • the unusual configuration of the parcel. <br /> • the presence of several easements totaling 3,875 square feet on the parcel. <br /> 2) The Board also determined desirable relief may be granted without substantial <br /> detriment to the public good and without nullifying or substantially derogating <br /> from the intent or purpose of such ordinance or By-law because of the following: <br /> • the proposal will meet the frontage, front, side, rear, setback and lot <br /> coverage requirements. <br /> • the proposal will be an enhancement and is similar in nature to other <br /> homes in the immediate neighborhood. <br /> In view of the foregoing, the Board determined that the Petitioner met the criteria <br /> necessary for grant of a Variance. Upon motion duly made and seconded, the Zoning <br /> Board of Appeals voted unanimously at the Public Hearings on April 25, 2012 to grant a <br /> Variance of 3,581 square feet from the land space requirements to allow for the proposal. <br /> This Decision is conditioned upon compliance with Vanasse Hangen Brustlin, <br /> Inc. plan dated July 15, 2005: Lot 36 Shoestring Bay Estates Willowbend Country Club, <br /> Mashpee, MA. <br /> 4 <br /> 2 <br />
