MASHPEE ZONING BOARD OF APPEALS <br /> David Wood, Trustee of Lot 20 Pleasant Park Drive Nominee Trust <br /> 10 Pleasant Park Drive <br /> Mashpee, MA 02649 <br /> V-2012-17 <br /> General Findings <br /> The subject property is located at 10 Pleasant Park Drive and consists of 22,500 square <br /> feet of land. <br /> Specific Findings: <br /> 1) The Board determined that a literal enforcement of the provisions of the By-laws <br /> would involve substantial hardship, financial or otherwise, to the Petitioner due to <br /> the following: <br /> • the unique soil conditions with the presence of wetlands on the parcel <br /> impacts location of the proposal. <br /> 2) The Board also determined desirable relief may be granted without substantial <br /> detriment to the public good and without nullifying or substantially derogating <br /> from the intent or purpose of such ordinance or By-law because of the following: <br /> • the proposal will meet the front, side, rear, setback and lot coverage <br /> requirements. <br /> • the proposal will be an enhancement and is similar in nature to other <br /> homes in the immediate neighborhood. <br /> In view of the foregoing, the Board determined that the Petitioner met the criteria <br /> necessary for grant of a Variance. Upon motion duly made and seconded, the Zoning <br /> Board of Appeals voted unanimously at the Public Hearings on April 25, 2012 to grant a <br /> Variance of 25 feet from the frontage requirements and a Variance of 17,500 square feet <br /> from the land space requirements to allow for construction of a single-family home on the <br /> subject parcel. <br /> This Decision is conditioned upon compliance with Down Cape Engineering, Inc. <br /> plan: Zoning Building Envelope, Site Plan of Land #10 Pleasant Park Drive in Mashpee, <br /> Owner of Record: Lot 20 Pleasant Park Nominee Trust, Date: November 14, 2007. <br /> 2 <br />
