MASHPEE ZONING BOARD OF APPEALS <br /> Decision for Minor Modification <br /> Comprehensive Permit CP-2010-29 <br /> Nothing herein may be construed as governing or waiving any requirements or <br /> agreements for such connection. <br /> 11. Nothing herein may be construed as providing permission for a connection to a <br /> public water supply or sewer system. The Applicant has entered into a <br /> Wastewater Agreement with the Town of Mashpee. No occupancy permit for any <br /> of the new units shall be issued until the Applicant provides the Board and <br /> Building Department with evidence that the connection to the Town's wastewater <br /> treatment system and the public water supply are operational. <br /> 11. The Final Site Plans shall contain a final design of the drainage system that <br /> exhibits compliance with all applicable best management practices and any <br /> applicable Stormwater Management Guidelines promulgated by the DEP or the <br /> Commonwealth of Massachusetts, as well as reasonable requirements that may be <br /> imposed by the Board, in consultation with its engineer and the DPW. The <br /> Massachusetts Stormwater Guidelines shall apply to the entire stormwater <br /> management system even if there are no wetland resource areas present. Should <br /> any requirements reasonably imposed by the Board's engineer result in a material <br /> change to any aspect of the Project, the Board's approval under 760 CMR <br /> 56.05(11) must be obtained. Additionally, an.operation and maintenance plan for <br /> the stormwater system must be approved by the Board's engineer. <br /> 12. With respect to each of the Applicant's requests for waivers from local by-laws <br /> and regulations, the Board hereby decides as follows: <br /> I. The Board approves waivers to dimensional and uses requirements in the <br /> Zoning Bylaws only to the extent necessary in order to build the Project <br /> that is shown on the Plans and approved Final Site Plans. <br /> 2. No waivers are granted from requirements that are beyond the purview of <br /> G.L. c. 40B, §§20-23. <br /> 3. No waivers are granted from permit, connection or inspection fees. <br /> 4. Any by-law or regulation not expressly waived hereunder shall be strictly <br /> enforceable. Any subsequent revision to the Plans, including but not <br /> limited to revisions that are apparent in the Final Site Plans that require <br /> additional or more expansive waivers of any local by-laws or regulations <br /> must be approved by the Board in accordance with 760 CMR 56.05(11). <br /> 13. All of the units shall be restricted as affordable rentals in perpetuity with <br /> minimums as established in accordance with State and Federal regulations, as the <br /> same may be amended from time to time. The rental amount shall be affordable <br /> for such households in accordance with any standards imposed by DHCD. The <br /> deed rider or use restriction (s) that are required in order to ensure the restrictions <br /> on affordability shall be submitted to the Town for review by the Board and its <br /> counsel prior to signing. Evidence of the recorded deed rider or use restriction(s) <br /> shall be provided to the Board. <br /> 6 <br />
