Mr. Ko harian seconded the <br /> motion. All voted unanimously. <br /> • AGE"A ITIRMS <br /> i <br /> Zoning Amendment <br /> Discussion of requested ZoningBy-law amendment regarding use of private wastewater treatment <br /> plants for undersized lots under Commercial CenterBy-law <br /> 1 Ir. Fudala provided the Board with five versions of the proposed amendment to the Mashpee Zoning <br /> By-law which includes a copy previously discussed by the Board, an edited version from Mr- Fudala, <br /> n edited version from Charles Rowley, an edited version from Douglas Storrs and a clean copy of the <br /> edited version from Mr. Fudala- <br /> Mr. Petersen questioned Mr. Fudala's version that states"long term basis by a private wastewater <br /> treatment facility whose use to service said lots is approved by the Planning Board" whereas Mr. <br /> Storrs' and Mr. Rowley's version sues"the center's special permit approved/issued by the-Planning <br /> Board" and questioned their differences in wording. Mr. Fudala responded that his version addremd <br /> the zoning at hand whereas the other versions include wording about the development agreement <br /> which complicates the by-law and is unnecessary. Mr. Fu felt that the by-law should not be <br /> limited to commercial centers that have entered into a development agreement. <br /> Mr. I o h ria.n added that he preferred Mr. Fudala's, on since it addresses the issue and the <br /> wording is less complicated. Chairman waygan sued that if Mr. Fudala did not feel it important to-tie <br /> the by-law into a development agreement then she would support his proposal. Mr. Fudala stated that <br /> the Planning Board could potentially review a commercial center project that does not involve a Cape <br /> Cod Commission Development Agreement but still wish to tie in to a private plant. The revised by- <br /> law would provide a i ,al means to more the project forward. <br /> 1 <br />
