The-re are - <br /> lots and more than 0 o-f open space, which is one parcel <br /> f land running along the river. <br /> Mr. Slavinsky proposed. construction of a 1 4-ft. gravel <br /> roadway with -inches of gravel., -inches of processed <br /> stone on top, and -ft . shoulder on each side extending <br /> from- the existing driveway to the end of lot 3 , He made <br /> reference to the low spot where the bioretent ion area is <br /> located, calling it a natural drainage spot. There will <br /> also be a natural drainage area at end of the gravel road, <br /> with a small bioretention area located at the existing <br /> house yard on the easterly side. <br /> The Town Planner suggested Applicant discuss this <br /> proposal with the Conservation Department; to which Mr. <br /> Slavinsy agreed. <br /> The Town Planner then explained that a subdivision of <br /> this size is required to be a cluster under the new bylaw. <br /> The process is two-fold, a Special Permit and Definitive <br /> Subdivision Plan. The Preliminary Plan that has been filed <br /> is unnecessary. Because a Special Permit h-as not been <br /> issued, the Planning Board is unable to approve the plan- <br /> before them, it does not meet minimum lot size or <br /> frontage requirements . <br /> The Town Planner has however, prepared a proposed <br /> Decision stating approval has been denied due t-o the <br /> following: Said proposal is a Cluster Subdivision and <br /> requires a Special Permit. The Fire Department has <br /> recommended proposed access should be allowed only if all <br /> proposed structures are protected with a residential <br /> sprinkler system (to which Applicant has agreed) . The <br /> March 1, 2007 Board of -Health preview indicates that the <br /> existing dwelling must be in compliance with all Title v <br /> regulations . There are .issues remaining. on. the Preliminary <br /> Plan Checklist, as well as issues of concern outlined in <br /> Mr. Rowley*-s letter dated March 21, 2007 . <br /> The process having been explained by the Town 'Planner <br /> and no further discussion from the Planning Board, the <br /> Chairman entertained a motion. <br /> 2 <br />
