The Chairman called this matter to order and <br /> recognized Dan Ojala, Land Surveyor, representing <br /> Applicant . <br /> References were. made to a plan of land entitled, "Plan <br /> of Land in Mashpee, MA, prepared for Duck Pond Limited <br /> Partnership, dated March 20, 200 " . <br /> Mr. of ala explained that Applicant would like t <br /> develop the rear section of this property project . The <br /> front of the property is zoned as part of the Overlay <br /> District that allows fo,r different uses. Applicant would <br /> life to use the back portion of the property for a self- <br /> storage facility, as indicated on planes filed with the Cape <br /> Cod Commission.. The intent is to provide for two separate <br /> and distinct uses. A mylar .plan has been prepared <br /> indicating two-separate lots., as required by a Board of <br /> Health condition. <br /> There was some discussion regarding access with <br /> references made. to imon' s Road, Trinity Place, and the <br /> location of the drainage ditch. There are existing curb <br /> cuts. <br /> The Town Planner spoke to three (minor) zoning issues <br /> of concern . Frontage of o -ft. is required uired in the event <br /> the lot has frontage only on route 151 and Route 28 . The <br /> driveways are already ]wilt out and curb cut-s have been <br /> issued. The Bylaw states that in the event of a split lot <br /> situation k etWeen two zoning districts, the newly created <br /> let cannot extend beyond o-ft . into a different zoning <br /> district. Both of the -proposed lots exceed 0--ft . from the <br /> IC-Overlay District, however the entire property is within <br /> the I-1 Industrial Zone. The Bylaw also states that a <br /> building cannot- be located within 10-ft . of route 2 , and <br /> that the minimum lot width must be maintained as the entire <br /> front yatd. <br /> All of these determinations to be made by the Planning <br /> Board vote in this matter. <br /> Them was some discussion regarding the necessity for <br /> easements- with the Daddario property. Modifications to the <br /> Special Permit will have to be made for ownership and <br /> parking issues . <br /> 4 <br />
