McAdams, Petitioner, <br /> requesting a Special Permit under Section 174-25.E(7) of the Zoning By-laws to allow <br /> for kennel-free alternative doggy daycare, socialization and overnight boarding on <br /> property located in an I-1 zoning district at 46 Nicoletta's Way (Map 27 Parcel 160) <br /> Mashpee, MA. Owner of record: Terence Luff, Trustee. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 26, and November <br /> 2, 2012, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> November 14, 2012. The following members of the Board were present and acting <br /> throughout: Board Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, <br /> and Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Owner of Talk to the Paws! Doggy Daycare Ms. Lisa J. McAdams and Property <br /> Manager Mr. Charles E. Harootunian represented the Petition. Ms. McAdams said that <br /> she is a Mashpee resident and hopes to move her doggy daycare business from Hyannis <br /> to Mashpee. Plans call for construction of a doorway connecting Units 7 and 8 at 46 <br /> Nicoletta's Way. Each unit consists of 1,000 square feet of space with an additional <br /> 1,000 square feet of outdoor space bordering Heritage Park in the rear of the building. <br /> This outdoor space will be fenced in. Ms. McAdams puts her clients and their dogs <br /> through a rigorous interviewing process and a trial day. Dogs that are not socialized or <br /> exhibit any sort of aggressive behavior are immediately rejected. She does not allow pit- <br /> bulls or chows. The drop off and pick up areas are separated to eliminate confusion and <br /> the possibility of escaping dogs. <br /> The Board expressed concern about waste removal and the potential for noise <br /> disturbance. Ms. McAdams said that dogs are exercised outside where the waste is <br /> gathered into bags and disposed of in a special dumpster. The ground is then sprayed <br /> with a special product that completely eliminates the odor. Ms. McAdams said that her <br /> neighbors in Hyannis, Sears and Cape Cod Beer,have never complained about noise. <br />
