The Town Planner made reference to lot elevations, especially Lots 23 and 23A a <br /> they are located within the flood area. The original l -lots subject to the covenants were <br /> held basically as leverage to resolve the overall flooding issues, not all ofthe lots are <br /> prone to-flood-.. He,also- de'referenee to-a-statement made in Attorney Losordo's letter <br /> dated October 11, 2007 indicating that all of the road covenants have been released. <br /> The Town Planner clarified that the road covenants for the 1 -lots have nearer <br /> been released. <br /> The Chairman recalled that this matter has:been discussed at prior meetings and <br /> that she was under the impression that an understanding had been reached in this matter <br /> that the covenants had not been released. This understanding had been determined by <br /> review of past Planning Board/Staff Mindtes and Subdivision Records. <br /> Mr. Rooney suggested that in the event the Board chooses to vote to release the <br /> covenants that it is done-with the express understanding that no determination is being <br /> made for the individual lots should they flood in the future. He also ugested that <br /> references to septic systems, etc. would fall under the jurisdiction ofthe.Board of Health. <br /> The Town Planner further stated that there are no direct flow connections between <br /> Ma hpee Pond-and the subject area. <br /> Mr. Rowley suggested that whatever is to be released should reflect those <br /> conditions outlined in the original approval. Basically it states that difficulty in <br /> developing the lots due to the existence of an extremely high water table impacting the <br /> lots. Applicant has demonstrated that the groundwater for each of the lots is below the <br /> level of development. <br /> The Town Planner spoke to the unique geology of the area stating he has some <br /> reservations with the release of the covenant on the lower lots. The water level rises <br /> rapidly in this area due to the porous material. The Quaker Run Valley area appears to <br /> react differently than the surrounding areas under heavy snow/rain conditions. He is not <br /> convinced that flooding conditions would not occur again in the loner lots. There is a <br /> possibility that the cranberry bog may contribute to the flooding situation. <br /> There being no further Board, Staff, or Public comment, this matter was then <br /> continued to the December 19, 2007 meeting. <br /> Definitive Subdivision Flan <br /> Scott Bauer-8 Blue Castle give <br /> Subdivision of One Lot Into Two and Approval of Easement <br /> The Chairman called this matter to order and recognized Stephen Doyle, <br /> representing the Applicant. <br />
