MASHPEE ZONING BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT Owner of record: First Citizens Federal Credit Union SP-2011-28 First Citizens Federal Credit Union Assessor's Map 74 Parcel 19B 71 Jobs Fishing Road Document Number: 1,154,259 Mashpee, MA 02649 Certificate Number: 193031 Land Court Plan: 34844-C Lot 7 A Petition was filed on June 7, 2011 by First Citizens Federal Credit Union for a Special Permit under Section 174-51.B of the Zoning By-laws for permission to install a sign exceeding twenty square feet onto a commercial building on property located in a C-1 zoning district at 71 Jobs Fishing Road(Map 74 Parcel 19B)Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on May 24, and July 1, 2011 a copy of which is attached hereto and made a part hereof. Public Hearings were held on the Petition at the Mashpee Town Hall on July 13, 2011. The following members of the Board were present and acting throughout: Board Members Robert G. Nelson, Jonathan D. Furbush, William A. Blaisdell and James Reiffarth and Associate Member Judith M. Horton. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. Mr. Richard Beaumont of Beaumont Signs represented the Petition. Plans call for two gold stars to be painted onto both of the existing wall-mounted signs on the building. Addition of the gold stars to the signs will exceed the 20 square-foot maximum allowed in the By-laws by 8 square feet. The Board noted that the Petition was submitted in error to the ZBA office. There are two signs, not just one sign. One sign has been installed on the entrance of the building and one sign has been installed on the side of the building. Mr. Nelson said that the Design Review Committee approved the proposed signs with the stipulation that the Petitioner would request and obtain ZBA approval for addition of the gold stars to the signs. Mr. Ernest Farren of 76L Shellback Way said that he hasn't seen the plans, but expressed his opposition to the Petition because it will encourage others to install over- sized signs. After looking at the plans, Mr. Farren retracted his earlier statement and said that he was not opposed to the proposal.
