Yurek <br /> 199 Daniels Island Road <br /> Mashpee,MA 02649 <br /> SP-2011-34 <br /> Zoning Board of Appeals employed in 1994, the lot coverage will increase from <br /> 24.6%to 28.2%, or 3.6%. <br /> FINDINGS <br /> The Board of Appeals, after carefully considering all the facts and evidence <br /> submitted at the hearing,made the following findings: <br /> 1. The subject property is located at 199 Daniel's Island Road (Mashpee <br /> Assessor's Map 100 Block 35) and is situated in an R-3 Residential District. <br /> 2. The subject property consists of 28,952 square feet; 20,651 square feet of <br /> which is upland and 8,301 feet of which is wetlands. <br /> 3. The existing structures are pre-existing, non-conforming structures and <br /> lawfully exist pursuant to Special Permit SP-94-61 which was issued in 1994 <br /> and which was timely exercised. <br /> 4. The proposed modifications to the structures will increase the non- <br /> conforming nature of the existing structures in a single respect: lot coverage. <br /> The increase in lot coverage will be 3.6% over what currently exists. <br /> 5. The existing lot coverage is non-conforming. The increase in lot coverage is <br /> insignificant. <br /> 6. Furthermore, the location of the proposed addition — centered between the <br /> existing dwelling and the existing garage — will have an inconsequential <br /> impact upon the appearance and massing of the existing structures and will <br /> not adversely affect the neighbors. <br /> 7. The modifications to the existing structure will result in a structure that will <br /> be two and one-half stories and will comply with the height and story <br /> requirements set forth in the Mashpee Zoning Bylaw. <br /> 8. Any impacts from the proposed increase in lot coverage are mitigated by the <br /> fact that the subject property abuts an area set aside as open space for the <br /> neighborhood. <br /> 9. The immediate neighborhood consists of single family homes of similar or <br /> larger size and many have been reconstructed from the original dwellings. <br /> 10. The size of the proposed dwelling will be consistent with the existing <br /> dwellings on the surrounding properties and the neighborhood as a whole: <br /> the dwelling to the north is 4,630 square feet (property at 202 Daniels Island <br /> 3 <br />
