MASHPEE ZONING BOARD OF APPEALS <br /> Gregory J. and Carol L. Yurek <br /> 199 Daniels Island Road <br /> Mashpee, MA 02649 <br /> SP-2011-34 <br /> Road); the dwelling to the west is 3,800 square feet (the property at 211 <br /> Daniels Island Road); and the dwelling to the south is 3,350 square feet (the <br /> property at 187 Daniels Island Road). <br /> 11. The proposed addition meets all applicable dimensional regulations other <br /> than lot coverage. The only increase in nonconformity is the 3.6% increase <br /> in lot coverage. Since this increase is relatively minor and will result in a <br /> structure that is consistent with those in the surrounding neighborhood, the <br /> proposed project will not be substantially more detrimental to the <br /> neighborhood than the existing structure. <br /> 12. The Board has the authority to make minor modifications to the site plan <br /> projects permitted by Special Permit pursuant to Section 174-24.C.9(A), <br /> including changes to the shape and location of buildings. <br /> 13. The proposed modifications are minor and may be approved under Section <br /> 174-24.C.9(A). <br /> 14. The Board also has the authority to modify Special Permits pursuant to 174- <br /> 24.C.9(B). <br /> 15. This subsection authorizes changes to the site plan of a project which, in <br /> combination with previous modifications, if any, increase the square footage <br /> of residential or non-residential structures by more than five percent (5%), <br /> increases the land area occupied by any use by more than five percent (5%) <br /> or which the special permit granting authority believed may potentially <br /> impact abutting land owners. <br /> 16. The proposed modification may be approved under either subsection (A) or <br /> (B) of Section 174-24.C.9. <br /> For the foregoing reasons, the Board determined that the Petition met the <br /> criteria necessary to grant a Special Permit. The Board found that the proposed <br /> modification would not result in a substantial detriment to the neighborhood and that <br /> the proposed modifications are authorized under Section 174-24.C.9(A) and/or(B). <br /> Upon Motion duly made and seconded, the Board of Appeals voted <br /> unanimously on October 12, 2011 to grant the requested modification to Special <br /> Permit No. SP-94-61.
