ow <br /> Town of r Cl C <br /> O �ti <br /> ' , <br /> 16 G <br /> S SIL�J('e, IrsOaf mot t12 <br /> MASHPEE ZONING BOARD OF APPEAL1,, IIctssacl7, 02649 <br /> DECISION FOR A FINDING OF FACT/SPECIAL PERMIT <br /> Steven and Lucinda Adams SP-10-04 Certificate Number: 189112 <br /> 370 Monomoscoy Road Lot 58-A Plan 15281-E <br /> Mashpee, MA 02649 Map 125 Parcel 16 <br /> A Petition was filed on January 21, 2010 by Steven and Lucinda Adams of <br /> Jefferson, Massachusetts for a Finding of Fact under Section 174-17 of the Zoning <br /> By-laws pertaining to non-conforming buildings and uses on property located in an R-3 <br /> zoning district at 370 Monomoscoy Road (Map 125 Parcel 16)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on February 5, and February <br /> 12, 2010, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 24, 2010, at which time the following members of the Board were <br /> present and acting throughout: Robert Nelson, Jonathan Furbush, William Blaisdell, <br /> Ronald Bonvie, and John Dorsey. Mr. Reiffarth stepped down from this Petition. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. and Mrs. Adams represented their Petition and submitted plans with original <br /> architectural signature. The proposal is to tear down the existing buildings and replace <br /> the existing foundations in the same exact footprint. Building Commissioner Richard <br /> Stevens confirmed that the lot is protected as long as the proposed construction is <br /> maintained on the same footprint. Mrs. Adams submitted a copy of the deed and said that <br /> the two buildings can never be sold separately and will always remain as one parcel. <br /> Mr. John Slavinsky, Engineer from Cape & Islands Engineering, also represented <br /> the Petition and said that construction will include installation of a frost wall. <br /> The Conservation Commission has approved the project with numerous <br /> conditions. <br /> The Board of Health has approved installation of a new Title V Septic system, <br /> which has replaced the two cesspools on the subject property. <br /> oz. �[d l— dvw 01. <br /> No comments were received from abutters. <br /> 1 <br />
