MASHPEE ZONING BOARD OF APPEALS <br /> Steven and Lucinda Adams <br /> 370 Monomoscoy Road <br /> Mashpee, MA 02649 <br /> SP-10-04 <br /> GENERAL FINDINGS: <br /> 1. that the subject property is located at 370 Monomoscoy Road and consists of <br /> 5,625 square feet. <br /> FINDING OF FACT CRITERIA: <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General Law Chapter <br /> 40A, Chapter 6,require a finding that the change, extension or alteration shall not be <br /> substantially more detrimental than the existing nonconforming structure or use to the <br /> neighborhood and that there is adequate land area to provide sufficient parking and <br /> setbacks as may be required. <br /> SPECIFIC FINDINGS: <br /> 1. that the proposal is not substantially more detrimental and will be an <br /> improvement to the property. <br /> 2. that there is adequate land area to provide sufficient parking. <br /> 3. that the new dwelling will comply with all setback requirements. <br /> 4. that installation of a new Title V Septic System will be a substantial <br /> improvement to the property and surrounding neighborhood. <br /> 5. that the new dwelling will be built in compliance with flood zone regulations, <br /> which will be an improvement of the existing situation. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the Finding of Fact. Upon motion duly made and <br /> seconded, the Zoning Board of Appeals voted unanimously on February 24, 2010 to grant <br /> a Finding of Fact. The Finding of Fact is conditioned upon compliance with the <br /> following: <br /> • Cape &Islands Engineering Plan Entitled: "PROPOSED HOUSE <br /> RECONSTRUCTIONS PREPARED FOR STEVE & CINDY ADAMS, HSE. <br /> NO. 370 & 370A MONOMOSCOY ROAD, MASHPEE, MASS. PLAN NO. <br /> 111609,FILE NO. 111MA, SEPTIC FILE NO. 76, SCALE: 1"=20', DATE: <br /> NOV. 16, 2009, PCS FILE: mono370". <br /> • The travel way shall be limited to a width of 12 feet and it shall abut the easterly <br /> line of the way. <br /> • Parking on the lot shall be in the area referred to as the"Way". The parking area <br /> to the subject property shall not be accessed from Monomoscoy Road. <br /> 2 <br />
