The Chairman, Patrick Coffey, presided. <br /> ZF <br /> Planning Board Members resent: Patrick Coffey, Chairman- <br /> Dennis Bal zarini, Vice Chairman; John Kuchinski, Clerk. <br /> Absent: Robert Govoni. <br /> r <br /> Also present : Thomas Fudala, Town Planner; Eric Smith, <br /> Assistant Town Planner. <br /> Signature-Approval Not Rewired-Stephen Giatrelis <br /> The Chairman declared a quorum to be resent and called the <br /> � p <br /> Meeting to order. As the first order of business he recognized <br /> Mr. Giatrelis. Mr. Giatrelis presented -plan entitled, Plan of " <br /> Land Located in Mashpee, MA. , prepared for Stephen Giatrelis, <br /> July 16, 1997, Cape & Island Engineering. He made reference to <br /> said Plan, indicating a previous Board of Appeals recommendation to <br /> of a 25 f t. easement; noting that Lot-#4 is ident if ied as <br /> unbuildable; with three Lots remaining. : <br /> (Martine Meijering arrived at the Meeting at this point, <br /> 6:45 p.m. ) <br /> The Chairman recognized Thomas Fudala, who informed the <br /> Board that according to Law, this matter has to be addressed <br /> under Subdivision Filing Public Hearing; an ANR has to have the <br /> legally required frontage under zoning. This matter has to be � I <br /> addressed as a Subdivision. Filing, through a Public Hearing, with <br /> a Vote to waive frontage requirements. Applicant would then be <br /> referred back to the Board of Appeals for a variance. Mr. Fudala <br /> explained an error had been made by the Board by way of <br /> procedure; the ANR� P1an stands, there is no way the Board could <br /> rescind the decision; the proposed change has to be made at a <br /> Definitive Plan Public Hearing. <br /> Mr. Fudala suggested the Board file the Plan as a <br /> Definitive, submit an application form, Vote to waive the <br /> preliminary requirements and schedule a Public Hearing (4 5-days) <br /> He also suggested the signature lines on the Plan be revised. i{ <br /> The Chairman and Town Planner were specific in clarifying <br /> the ANR process, recording requirements, as well as the Public t <br /> Hearing/Appeal process . At this point, application forms were <br /> provided to the Applicant. (This matter concluded at 6:50 p.m. ) <br />
