The Plaintiff,James Regan,requested an opinion from Defendant Stevens relative <br /> 12 Brookside Circle,Mashpee,Massachusetts(hereinafter the"Property")which is owed by <br /> to Defendants Marsolais. <br /> 15. Regan is an abutter to the Defendant Marsolais,property. <br /> 16. The Marsolais property is part of a cluster subdivision originally authorized by the <br /> Mashpee Planning Board on 7/18/84,and by the Mashpee Zoning Board of Appeals under their <br /> case#SP-84-5-023 on 6/21/84. <br /> 17. The Marsolais properly is located on a cul de sac..The approved plan,recorded of <br /> Plan Book 392 page 24 and 25 of the Barnstable Registry of Deeds,shows the site as Lot 247. <br /> 18. On the approved plan,superimposed on the lot is a short dashed line labeled <br /> TV;i.e.,the"Building Line". <br /> 19. The Plaintiff Regan sought an opinion from the Defendant Stevens that the"BL" <br /> line is a building setback for the Marsolais Property and that Zoning Relief would be required to <br /> construct a dwelling on the lot closer to the street than the Building Line shown on the <br /> subdivision plan. <br /> 20. The Defendant Stevens issued his opinion in a letter dated September 16,2010, <br /> which opinion was contrary to the position put forth by the Plaintiff Regan. <br /> r <br />
