21. The Plaintiff,James Regan,appealed the Zoning Opinion promulgated by <br /> Defendant Stevens to the ZBA. <br /> 22. On or about February 9,2011,after a hearing,the ZBA denied the appeal of <br /> Regan. A certified copy of such Decision is attached hereto as Exhibit A. Such Decision was <br /> filed with the Town of Mashpee Town Clerk on February 15,2011. <br /> 23, The Decision of the ZBA was arbitrary,capricious,not based upon <br /> substantial evidence in this matter,and exceeds the authority of the ZBA.. <br /> 24. The Decision of the Order issued by the Mashpee Zoning Board of Appeals has <br /> resulted and will result in substantial injury and manifest injustice to Regan. <br /> 25. Regan is an abutter to the property relative to which the Decision was issued and <br /> is aggrieved by the Order. <br /> 26.
