MASHPEE ZONING BOARD OF APPEALS <br /> 154 Industrial Drive <br /> Mashpee,MA 02649 <br /> Petitioner: Clearwire <br /> Owner of record: SBA Properties, Inc. <br /> SP-10-43 <br /> Mr. Kallio also submitted a report from Radio Frequency Engineer Lauren Owen <br /> entitled: "Evaluation of Compliance with Guidelines for Human Exposure to Radio <br /> Frequency Radiation for Clearwire LLC". The report was prepared to analyze the <br /> expected level of Non-Ionizing Electromagnetic Radiation caused by the addition of <br /> radio transmission equipment to the existing site. The report indicated that transmissions <br /> at this site by the proposed Clearwire transmissions are well below the 100% limit and no <br /> exposure risk should exist. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS: <br /> The subject property is located at 154 Industrial Drive with an existing 250-foot radio <br /> tower and 80,758 square feet of open space. <br /> SPECIAL PERMIT CRITERIA: <br /> §174-45.3. Personal Wireless Service Facilities. <br /> J. Co-location. <br /> • Licensed carriers shall share personal wireless service facilities and sites where <br /> feasible and appropriate, thereby reducing the number of personal wireless service <br /> facilities that are stand-alone facilities. All applicants for a special permit for a <br /> personal wireless service facility shall demonstrate a good faith effort to co-locate <br /> with other carriers. <br /> • If the applicant does intend to co-locate or to permit co-location, the Board shall <br /> request drawings and studies that show the ultimate appearance and operation of <br /> the personal wireless service facility at full build-out. <br /> • If the Board approves co-location for a personal wireless service facility site, the <br /> Special Permit shall indicate how many facilities of what type shall be permitted <br /> on that site. Facilities specified in the Special Permit approval shall require no <br /> further zoning approval. However, the addition of any facilities not specified in <br /> the approved Special Permit shall require a new Special Permit. Estimates of RFR <br /> emissions will be required for all facilities, including proposed and future <br /> facilities. <br /> In view of the foregoing, the Zoning Board of Appeals determined that the <br /> Petitioner met the criteria necessary for granting of a modification of a Special Permit <br /> (SP-97-70 - Registry of Deeds Title Reference: Book: 11377 Page: 084). Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on November <br /> 10, 2010 to grant the modification of a Special Permit to allow for the proposal. This <br /> Decision is conditioned upon compliance with Fullerton Engineering Consultants plan: <br /> Clearwire Wireless Broadband, Site Name: Cape Cod, Site Number: MA-BRNS004-A, <br /> Site Address: 154 Industrial Dr. Mashpee, MA 02649, Project Type: New Wimax <br /> Antennas and Equipment Cabinet, Equipment Type: DAP, Date 9/28/10, 10/4/10. <br /> 2 <br />
