MASHPEE ZONING BOARD OF APPEALS <br /> Paul Tragiannopoulos <br /> 593 Main Street <br /> Mashpee, MA 02649 <br /> V-10-45 <br /> zoning district in which it is located, a literal enforcement of the provisions of the <br /> ordinance or by-law would involve substantial hardship, financial or otherwise, to the <br /> petitioner or appellant, and that desirable relief may be granted without substantial <br /> detriment to the public good and without nullifying or substantially derogating from the <br /> intent or purpose of such ordinance or by-law. <br /> SPECIFIC FINDINGS: <br /> The Board determined that: <br /> 1. due to soil conditions affecting the subject property, the existing septic system <br /> restricts location of the proposal; therefore, a literal enforcement of the <br /> provisions of the ordinance or by-law would involve substantial hardship, <br /> financial or otherwise, to the Petitioner. <br /> 2. construction of the structure will be the same roof height as the existing garage <br /> and will not be visible from the street; the proposal will move the sandblasting <br /> currently being done outside into an enclosed, sound-proof building, which will <br /> eliminate dust, noise and outside parking of numerous vehicles; therefore <br /> desirable relief may be granted without substantial detriment to the public good <br /> and without nullifying or substantially derogating from the intent or purpose of <br /> such ordinance or by-law. <br /> In view of the foregoing, the Zoning Board of Appeals determined that the <br /> Petitioner met the criteria necessary for granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on December 8, <br /> 2010 to grant the following: <br /> • a Variance of 17.2 feet from the left rear of the structure. <br /> • a Variance of 3.9 feet from the right rear of the structure. <br /> This Decision is conditioned upon compliance with the following: <br /> • BSS Design plan entitled: "Plot Plan — Proposed Garage Prepared for Paul <br /> Tragiannopoulos, 593 Main Street (Lot 2) Mashpee, Massachusetts, Date: Nov <br /> 15, 2004, Revisions: 01-11-06, 02-23-06, 02-28-06, 11-19-2010". <br /> • Giampietro Architects Plan entitled: "Proposed Garage, Paul Tr'agiannopoulos, <br /> 593 Main Street (Lot 2) Mashpee,MA, Date: Nov. 12, 2010". <br /> 3 <br />
