MASHPEE ZONING BOARD OF APPEALS <br /> Paul Tragiannopoulos <br /> 593 Main Street <br /> Mashpee, MA 02649 <br /> V-10-45 <br /> } The Board noted the large size of the property and made several suggestions to <br /> relocate the garage in order to comply with setback requirements. Mr. Tragiannopoulos <br /> said that he has exhausted several options on the location of the proposal and has spent <br /> thousands of dollars in site plan and architectural drawings. He said that placing the <br /> large garage in front of his residence would be extremely unattractive from a visual <br /> aspect. In addition, the location of the septic system restricts placement of the proposed <br /> garage. Mr. Tragiannopoulos said that attaching the garage to the house would prevent <br /> him from installing an addition onto his home in the future. He said that the electrical <br /> service from the street and the gas and water services were all positioned in order to <br /> accommodate a future addition onto his home. Locating the proposal on the other side <br /> of the house would eliminate the existing driveway and deck. <br /> Mr. Hinden stated that the proposed location for the structure is the most <br /> sensible since it is in the rear of the property and will not be visible from the street. He <br /> also said that the location abuts open land on property owned by a company that does <br /> not object to the proposal. <br /> Mr. Thomas Wilson, an abutter at 581 Main Street two doors down from the <br /> Petitioner, said that he is opposed to the project. He stated that he issued complaints to <br /> the Building Commissioner in October and November about the noise and dust created <br /> by the sandblasting. Mr. Wilson said that he signed a document in favor of the <br /> proposal,but was in a hurry and distracted when he did so. He expressed concern that <br /> the Petitioner will increase his sandblasting activity with construction of the garage. <br /> Mr. Tragiannopoulos said that there is an Industrial Park located directly across <br /> the street from his house and from Mr. Wilson's. Mr. Tragiannopoulos said that the <br /> activity from the Industrial Park generates more traffic, noise and dust from trucks than <br /> he would ever be able to create on his property from the sandblasting activity. <br /> The Board members said that they sympathized with Mr. and Mrs. Wilson and <br /> that they are optimistic that construction of the garage will help solve some of the noise <br /> problems. <br /> GENERAL FINDINGS: <br /> The subject property is located at 593 Main Street and consists of 43,560 square feet of <br /> land. <br /> VARIANCE CRITERIA: <br /> Chapter 40A: Section 10 states: <br /> The permit granting authority shall have the power after public hearing for which notice <br /> has been given by publication and posting to grant upon petition with respect to <br /> particular land or structures a Variance from the terms of the applicable zoning <br /> ordinance or by-law where such permit granting authority specifically finds that owing <br /> to circumstances relating to the soil conditions, shape, or topography of such land or <br /> structures and especially affecting such land or structures but not affecting generally the <br /> 2 <br />
