r <br />Mashpee Zoning <br />Board of Appeals Minutes <br />• 2 January 14, 2009 <br />for certain requirement of the ZBA, however, by marking <br />them up he has made them different from what <br />Conservation has approved. The plans should be dated <br />December 15, 2008 and revised on January 14, 2009. Mr. <br />Nelson asks the Kellehers to bring in the plans with the <br />proper date of 2009 on them. They agree to have this done. <br />The Board determines that the substance of the plan <br />remains the same. The Board reviews the plans and since <br />the Conservation Commission has granted the project to be <br />appropriate they find no problem with the granting of this <br />variance. James Reiffarth makes a motion to grant a 34 foot <br />variance to the wetlands. Jonathan Furbush seconds the <br />motion. All agree. So moved. Reference plans from Russell <br />Wheately Co., of Abington, MA dated December 15, 2008 <br />and revised January 14,2009. New plans with the year <br />"2009" will be submitted to the board. There was a mistake <br />in the plans whereby the year '1200811 was written in. The <br />applicants will submit new plans with the year "2009" typed <br />in. <br />Other Business: <br />Bob Nelson makes a motion to accept the minutes from <br />December 10, 2008 as amended. Peter Hinden seconds the <br />motion. All agree. So moved. <br />Bob Nelson discusses the Article 21 from the May 2007 <br />Town Meeting that allows members from regulatory boards <br />to miss one meeting/hearing and view the tape therefore <br />making them available to vote. Lori Corsi will check with the <br />Town Clerk for a copy of that article. <br />0 <br />
