• <br />application for special permit, and the second <br />decision is a denial of an application for variance. <br />II. PARTIES <br />2. Plaintiffs Janet E. Krock and Kathryn Krock are <br />Trustees of The Hubert Trust, u/d/t dated January 31, <br />2003 and recorded in the Barnstable Land Court <br />Registry as Document Number 913,586, as amended. <br />3. Defendants Robert Nelson, Jonathan Furbush, James <br />Reiffarth, William Blaisdell and Jack Dorsey are all <br />members of the Mashpee Zoning Board of Appeals and <br />residents of the Town of Mashpee. <br />III. FACTUAL ALLEGATIONS <br />4. Krock owns the Property, which is registered land and <br />is located in a district classified as "R-3" pursuant <br />to the Mashpee Zoning Bylaw ("Bylaw"). <br />5. A single-family dwelling is currently located on the <br />Property. <br />6. The Property constitutes a preexisting, nonconforming <br />lot, as it contains insufficient area and frontage <br />pursuant to the current provisions of the Bylaw. The <br />Property contains 5,000 square feet in area and 50 <br />feet of frontage. The Bylaw requires a minimum of <br />• 40,000 square feet in area and 150 feet of frontage. <br />
