4. That the Board held a public hearing relative to said Petition for Special Permit on April <br /> 22, 2009. <br /> % 5. The Board issued and filed its Decision on June 22, 2009. A copy of such Decision is <br /> attached hereto and marked `B." <br /> 6. The Decision of the Board exceeds the authority of the Board, is arbitrary and capricious, <br /> and was not based upon the evidence presented to the Board. <br /> WHEREFORE, the Plaintiff requests that this Court: <br /> 1. Annul the June 22, 2009 Decision of the Mashpee Zoning Board disapproving the <br /> Petition for Special Permit submitted by the Plaintiff on the grounds that the <br /> Decision is against the evidence presented to the Board as the Applicant made a <br /> showing entitling him to the granting of the special permit and the decision <br /> exceeds the authority of the Board. <br /> 2.
