Owner of Record: Town of Mashpee <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 19, 2009 and June 26, <br /> 2009, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hail on <br /> Wednesday, July 8, 2009, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James <br /> Reiffarth, William Blaisdell, John Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Karen Gardner, CFO of the Health Care Center of Cape Cod is present to address <br /> the Board. Also present is Tim Santos of Holmes and McGrath Engineering. They are <br /> asking the Board for a Modification of the Special Permit to allow for 56 more parking <br /> spaces on the lower site. There is a need to modify the Special Permit in order to <br /> accommodate the need for more parking for the existing building and the proposed <br /> building in the next phase. The existing property is adequate in size and is suitable for <br /> the intended development expansion of medical office and clinic within the Industrial <br /> Zoning District and the IC Overlay district. The proposed development plan will not <br /> change the lot coverage by structures of 4.9%, which complies with the maximum lot <br /> coverage by structures of 25%. The improvements to the site will have no effect on <br />
