Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on July 24, 2009 and July <br /> 31, 2009, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was scheduled to be heard on Wednesday, August 12, 2009 and <br /> continued until August 26, 2009 on the Petition at the Mashpee Town Hall, at which time <br /> the following members of the Zoning Board of Appeals were present and acting <br /> throughout: Robert Nelson, Jonathan Furbush, James Reiffarth, William Blaisdell and <br /> Peter Hinden. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane represented the applicant at this hearing. Jerry Darrah <br /> Polemus, Architect is also present for the applicant. They are seeking a Findings of Fact <br /> in order to change/alter the pre-existing non-conforming structure. They are seeking to <br /> add approximately 100 square feet of living space by adding additional decking and a <br /> boardwalk in the front of the dwelling. This will increase the lot coverage from 23.3% to <br /> 23.7%. Applicant is proposing 2 modest additions and one modest deck addition. These <br /> proposed additions will not make the dwelling any closer to the wetlands. The Board <br /> discusses the Findings of Fact and criteria for issuing that. Mr. Nelson mentions that <br />
