Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 21, 2009 and <br /> August 28, 2009 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was heard on Wednesday, September 9, 2009 on the Petition at <br /> the Mashpee Town Hall, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James <br /> Reiffarth, William Blaisdell and John Dorsey. <br /> John Slavinsky of Cape & Islands Engineering represents the applicant. They <br /> have filed a variance and a special permit/findings of fact for the project proposed. Mr. <br /> Slavinsky has now been made aware of the ruling from Town Counsel on Section 174-17 <br /> and believes he will be able to withdraw the variance request should the board see fit. <br /> They review the plans and discuss where the alterations will take place. They are adding <br /> a farmer's porch and a small addition which will sit 22 feet from the lot line which is 2 <br /> feet closer than the existing dwelling. The lot coverage will increase from 17%to 18.2% <br /> which is still under the 20% maximum. The Board agrees to have the variance <br /> withdrawn. James Reiffarth makes a motion to grant the Special Permit/Findings of Fact. <br /> William Blaisdell seconds the motion. All agree. So moved. <br />
