Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee, on August 21, 2009 and
August 28, 2009 a copy of which is attached hereto and made a part hereof.
A Public Hearing was heard on Wednesday, September 9, 2009 on the Petition at
the Mashpee Town Hall, at which time the following members of the Zoning Board of
Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James
Reiffarth, William Blaisdell and John Dorsey.
John Slavinsky of Cape & Islands Engineering represents the applicant. They
have filed a variance and a special permit/findings of fact for the project proposed. Mr.
Slavinsky has now been made aware of the ruling from Town Counsel on Section 174-17
and believes he will be able to withdraw the variance request should the board see fit.
They review the plans and discuss where the alterations will take place. They are adding
a farmer's porch and a small addition which will sit 22 feet from the lot line which is 2
feet closer than the existing dwelling. The lot coverage will increase from 17%to 18.2%
which is still under the 20% maximum. The Board agrees to have the variance
withdrawn. James Reiffarth makes a motion to grant the Special Permit/Findings of Fact.
William Blaisdell seconds the motion. All agree. So moved.
