Mashpee Zoning David Melish 2 <br /> Board of Appeals SP-08-03 <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant <br /> to the provisions of Massachusetts General Laws Chapter 40A Section 9 and <br /> the Town of Mashpee Zoning By-laws. <br /> David Melish represents himself at this hearing. He is seeking a Special Permit to <br /> partially demolish the existing dwelling and a variance on the northerly side. The Board <br /> reviews the plans. Mr. Nelson wants to have the address changed to "road" since it was <br /> advertised as "drive" and there is no Riverside Drive. The Board asks if the proposed <br /> property will be in the flood zoneāRich Stevens the building inspector says it will be 16 <br /> feet on the first floor and is fine. There is a second dwelling on the property and the <br /> building inspector informs the Board that it is pre-existing and the applicant is not doing <br /> anything to that. The shed is acceptable as well. The lot coverage of both dwellings and <br /> the shed total the 20% maximum. The float is seasonal and is acceptable. After some <br /> further discussion, Robert Nelson makes a motion to grant the special permit <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 and 174-20 of the Mashpee Zoning By-laws and <br /> Massachusetts General Laws Chapter 40A, Chapter 6, require a finding that <br /> the razing, extension, alteration or change shall not be substantially more <br /> detrimental to the neighborhood than the existing <br /> non-conforming-use. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 63 Riverside Road and <br /> contains 11,800 square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposal will decrease the non-conforming nature of the <br /> structure and the changes will not result in a structure or use which <br />
