Jabs-Whtings Trust
March 8,2013.
Mr.Jonathan Furbush,Chairman
Mashpee Zoning Board of Appeals
16 Great Neck Road
Mashpee MA 02649
Dear Jonathan and Members of the Board,
Jobs-Whitings Trust would like to request an extension of the Comprehensive
Permit granted to Jobs-Whitings Trust on February 7, 2007 on property
located off Rt. 151 and Rt.28 comprised of parcels shown as Map 73, Lot 10,
Map 74,Lot 34 and Map 74,Lot 20.
As you will remember, the Board previously granted an extension to this
permit through, what appeared to be the date of February 15, 2013.However,
due to the peculiarities of Chapter 40B Comprehensive Plan permits, the
Permit Extension Act and other unique situations and conditions, it appears
that the permit extension could not have expired on that date.
I have attached a document that Mike Ford, who has worked with us over the
years on various technical permitting items, compiled which provides the
background as to the permit, .the current status and how we can, hopefully,
work, together to address the date for a permit extension. Further, I asked
Joyce Mason to forward a copy to Pat Costello, Town Counsel so he could
review it and address any questions he might have in advance of our meeting.
We are at a point.where, after many years of delay due to the recent very
difficult financial period/recession we are attempting to move this important
project forward. However, this confusion as to the actual date of the permit
extension is creating certain issues as we begin to work with State Agencies
and lending institutions for the financing of the first phase of the project.
We are confident that there continues to be strong support in the community
to advance this project and to create this residential neighborhood which is
adjacent to,and an important part of, the Mashpee Commons Master Plan.We
trust that the Board remains committed to this project and we look forward to
working with the Board to finally advance the project.
We look forward to working with the Board on this request.
incer
DougI s S., rrs
0 half of Jobs- iti s
CC:Michael Ford Esq
Joyce Mason
RESIGN REVIE Signature
Date
PLAN REVIEW
PLANNING BOAR
ZONING ORD.OF APPEAL
CONSERVATION
2
