Mashpee Zoning Mashpee Commons Limited Partnership <br /> Board of Appeals SP-08-05 3 <br /> no adverse effect on public health or safety; that there will not be an excessive demand <br /> upon community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the enviroiunental factors listed in Section 174-24.C.2. <br /> SPECIFIC FINDINGS <br /> 1. that the proposed use and development are consistent with applicable law, <br /> rules and regulations. <br /> 2. that there will be no adverse effect on public health or safety. <br /> 3. that there will not be an excessive demand upon community facilities created <br /> as a result of the proposal. <br /> 4. that there will not be a significant adverse impact on the enviromuental factors <br /> listed in Section 174-24.C.2. <br /> 5. that the applicant has satisfied the requirements under Condition#5 of the <br /> original Special Permit. <br /> 6. There will be 3 handicapped parking spots, one of which will be van <br /> accessible. <br /> 7. This matter also requires variance relief both for the setback requirements and <br /> parking requirements. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded, the Zoning Board of Appeals voted unanimously on February 13, 2008 to <br /> giant a Modification to the original Special Permit, SP-86-04-024, as previously modified <br /> under Condition#5 and should reference The Special Permit Site Plan entitled"Master <br /> Plan Special Permit" dated November 20, 2003 as drawn by Imai Keller Moore <br /> Architects; <br />
