Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation on March 7, 2008 and March 14, 2008 , a copy of
which is attached hereto and made a part in the Town of Mashpee, on hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, March 26, 2008, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush,
William Blaisdell, Jack Dorsey and Peter Hinden.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Arthur Joia represents himself at this hearing. He is seeking a variance in order to
expand current living space and re-arrange and build a new deck. Mr. Joia was before the
Board in 2006 for a variance but did not complete that addition(a different version) due
to septic placemen issues. The Board notes that he is burdened with two frontages. Mr.
Nelson discusses the fact that at the previous hearing in 2006 he was asked to remove the
circular driveway since the by-laws do not allow 2 driveway entrances. Applicant will
abide by this request. The Board notes that the lot coverage will be at 12.76%. The
