Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on April 25, 2008 and May 2, 2008, a copy of which is <br /> attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 14, 2008 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James <br /> Reiffarth, William Blaisdell and Peter Hinden. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Donald McDonald—appliants uncle, represented them at this hearing. They are <br /> seeking variances on the setback requirements in order to build a deck on a very small <br /> lot. This lot is in the Popponesset Overlay District and requires 25 feet setback in the <br /> front, and 15 feet on the sides. Applicant originally came into the ZBA's office with a <br /> request of well over 25% lot coverage for this deck. Lori Corsi explained to the applicant <br /> that the ZBA will not allow more than 20% lot coverage in total. Mr. Hayes returned <br /> with a plan reducing the size of the deck considerably thus the 20.04 lot coverage, which <br /> negligible. The Board reviews the plans and finds the house very small as well as the lot. <br /> 4 <br />
