Mashpee Zoning
Board of Appeals Minutes
• 1 May 14, 2008
Zoning Board of Appeals
Minutes — Wednesday, May 14, 2008
The Mashpee Zoning Board of Appeals held a Public Hearing on
Wednesday, May 14, 2008. at the Mashpee Town Hall. Board
Members Robert Nelson, Jonathan Furbush, William Blaisdell, and
James Reiffarth were present. Alternate Board members Jack Dorsey
and Peter Hinden were present. Board Member Zella Elizenberry was
absent. Also present was Attorney Jenna Caruso of Pat Costello's
office to assist ZBA on the Peter White Appeal matter and the Library
variances.
• Robert Nelson opens the hearing at 7:00 pm.
Jonathan Furbush reads the continuances
Adam Haves: Requests a Variance from Section 174-31 of the Zoning By-laws to seek relief
from the frontyard setback requirements and lot coverage in order to build a 460 square foot deck
on property located in an R-3 zoning district at 112 Uncle Percy's Road (Map 117 Parcel 249)
Mashpee, MA.
Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, William Blaisdell and Peter
Hinden.
Donald McDonald applicants uncle, represented them at this hearing. They are seeking
variances on the setback requirements in order to build a deck on a very small lot. This
lot is in the Popponesset Overlay District and requires 25 feet setback in the front, and 15
feet on the sides. Applicant originally came into the ZBA's office with a request of well
over 25% lot coverage for this deck. Lori Corsi explained to the applicant that the ZBA
will not allow more than 20% lot coverage in total. Mr. Hayes returned with a plan
reducing the size of the deck considerably thus the 20 Tt&o)'aW wQU negligible.
The Board reviews the plans and finds the house very smalf as well as the lot. Applicant
is adding a deck in order to have more outside living space. The Board finds their request
• reasonable. Jonathan Furbush makes a motion to grant: NU31" HM01
13dHSVW JO "01
✓ A 5 foot front yard setback variance
