Mashpee Zoning <br />Board of Appeals Minutes <br />• 3 May 14, 2008 <br />Sitting: Robert Nelson, Jonathan Furbush; Jack Dorsey and Peter Hinden. <br />Martin Finch represented himself on this application for a variance in order to build a <br />deck. They are seeking side and front variance relief in order to build a front deck. <br />George Lambros, Builder for applicant is also present. Mr. Nelson right away asks what <br />the hardship is for this request. Mr. Finch tells the Board that the grading on the property <br />is so bad they cannot walk outside without a deck. The Board mentions that they already <br />have one deck and if they cannot possibly extend the side deck instead of building a new <br />one. Mr. Finch states that the double deck is more stable and looks better. The Board <br />and the applicant debate on some suggestions and alternatives instead of building another <br />deck. Robert Nelson mentions the average setback rule and says it would not apply <br />because applicant would be going out to far. Mr. Furbush suggests building a smaller <br />deck of 6 feet instead of the 8 foot one proposed. Mr. Finch is agreeable to that, <br />however, Mr. Nelson would not vote in a positive manner and feels this is not a hardship, <br />since he already has one deck. Mr. Lambros asks the board why they just granted the <br />previous applicant a deck and not them? Did they present a hardship? Mr. Nelson states <br />that they did not need nearly the variance request this applicant is looking for and they do <br />not have a deck to begin with. Further discussion ensues and there is a split feeling <br />amongst the board. There must be at least 4 positive votes to carry the motion. Jonathan <br />Furbush makes a motion to grant the variance. William Blaisdell seconds the motion. <br />Jack Dorsey votes yes. Mr. Nelson votes no. Mr. Reiffarth votes no. The Motion is <br />• denied. <br />Town of Mashnec: Requests a Variance from Section 174-31 of the Zoning By-laws to vary the <br />setback requirements and building height in order to build the new library on property located in a <br />C -I zoning district at 64 Steeple Street (Map 74 Parcel 31) Mashpee, MA. <br />Sitting: Robert Nelson, Jonathan Furbush, Peter Hinden, James Reiffarth and William <br />Blaisdell. <br />Richard Pomroy of South Easton, MA, Project Manager for the new library <br />represents the Town on the variance requests for the building. There are currently 5 <br />variances being applied to the ZBA for, 4 for setback and one for building height. The <br />proposed library will be a two story building and contain approximately 20,800 square <br />feet. This building will have the capacity to hold 380 occupants which is the build out <br />projection for the next 20 years. The bidding will commence in July and they anticipate <br />building to begin in October. Mr. Pomroy estimates the job should be complete in <br />approximately 16 months. <br />Mashpee Commons gifted the land to the Town with the provision that they <br />maintain design authority and review rights in order to align the character of the <br />municipal building with that of the proposed post office which is going to be built <br />directly next door, as well as the local flavor Mashpee Commons has built over the past <br />• twenty years. The buildings will share a common walkway and parking, thus offering <br />convenience to residents and ease some of the parking burden. The parking proposes <br />double rows and Ms. Laurent, Director of DPW states that the Town will accommodate <br />the 9 %z foot size parking dimensions required by the town by-laws.
