Mashpee Zoning Betsy Mello <br /> Board of Appeals Owner of Record: Roy Ricci <br /> 3 SP-08-24 <br /> will not cause excessive erosion or cause increased runoff onto neighboring <br /> properties or into any natural river, stream,pond or water body and will not <br /> otherwise be detrimental to the town or the area". <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 68/70 Nicoletta's Way and contains 4 <br /> plus acres. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposed use and development are consistent with applicable law, rules and <br /> regulations. <br /> 2. there will be no adverse effect on public health or safety. <br /> 3. there will not be an excessive demand upon community facilities created as a result of <br /> the proposal. <br /> 4. there will not be a significant adverse impact on the environmental factors listed in <br /> Section 174-24.C.2. <br /> 5. Letter attached indicates items to be completed within 90 of Special Permit being <br /> issued. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on May 28, <br /> 2008 to grant the Special Permit on the subject property. The Special Permit is <br /> conditioned upon compliance with letter attached and completed within 90 days of <br /> Special Permit being issued. <br /> 1 <br />
