Mashpee Zoning <br />Board of Appeals Minutes <br />i June 25, 2008 <br />Zoning Board of Appeals <br />Minutes — Wednesday, June 25, 2008 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on <br />Wednesday, June 11, 2008 at the Mashpee Town Hall. Board <br />Members Robert Nelson, Jonathan Furbush, James Reiffarth and <br />William Blaisdell were present. Alternate Board members Jack Dorsey <br />was present. Board Member Zella Elizenberry, and alternate member <br />Peter Hinden were absent. <br />Chairman Robert Nelson opens the hearing at 7:00 p.m. <br />Jonathan Furbush reads the continuances. <br />Alex MacLellan: Seamist Builders - 403 Great Oak Road — Extension on <br />existing variance. Mr. MacLellan would like to address the Board regarding <br />his variance. <br />Mr. MacLellan owns a lot on 403 Great Oak Road and was issued a <br />variance that is due to expire the end of July. He is first, asking the Board <br />for a 6 month extension. He addresses the Board about how difficult the <br />economy has been for him and that he doesn't know what he will do if he <br />cannot sell the lot. He was told originally that it was part of Little Neck Bay <br />and there was only a 15,000 square foot requirement to be a buildable lot. It <br />is in an R-3 zoning district and the variance shows that it required 40,000 <br />square feet to be buildable and he also needed relief from the ACEC due to <br />the house he presented on the lot to be built. The Board makes some <br />suggestions as to what he would need to do to show the lot is part of Little <br />Neck Bay and then perhaps would not need a variance. Mr. Nelson <br />discusses the water pipe that the Town put in that lies within his property. <br />Mr. Furbush suggests going to the Registry of Deeds to prove he is part of <br />the Little Neck Bay area. They will need written proof and some sort of <br />subdivision plan to begin with. The ARC in New Seabuty may be able to <br />help his as well. Mr. MacLellan mentions that he would have had the land <br />sold to the person who bought his other lot neat door however, he wanted it <br />for his children many years from now and the variance will expire after one <br />year. Mr. MacLellan again says how desperate he is and his whole life is <br />tied up in,this lot. The Board acknowledges that the economy is very bad <br />
