Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on June 27, 2008 and July 4, 2008, a copy of which is <br /> attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 9, 2008 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James <br /> Reiffarth, William Blaisdell and Jack Dorsey <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Scott Wheeler represents himself at this hearing. He is seeking a variance in <br /> order to expand existing living space. The Board of Health has condemned the house due <br /> to no heating system. Applicant is attempting to improve the home in order to be able to <br /> rent the space again. Abutter Paul Nolan has submitted a letter which Robert Nelson <br /> reads into the record, strongly opposing the variance. He states that the house is a <br /> complete mess,the tenants have been loud and have not kept up the property and this <br /> expansion will make the house closer to his property. Mr. Wheeler has indicated to the <br /> Board that he has landscaped the property and is aware of the list of complaints from the <br />
