Mashpee Zoning
Board of Appeals Scott Wheeler
2 V-08-32
Board of Health. The ZBA suggest he make amends with his neighbor and will require
all Board of Health complaints to be taken care of. Jonathan Furbush feels the
improvements will better the house and improve the neighborhood. Chairman Nelson
asks the Building Inspector if he has any problems with this variance request? Rich
Stevens has no problems with this request. Jonathan Furbush makes a motion to grant an
8 foot variance on the southwesterly side and a 13.5 foot variance on the northeasterly
side.
GENERAL FINDINGS
1. that the subject property is located at 51 Santuit Pond Road and contains
13,000 square feet .
SPECIFIC FINDINGS
The Board determined that:
1. a literal enforcement of the By-laws would involve substantial hardship to
the petitioner.
2. Desirable relief maybe granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or
purpose of the by-law.
In view of the foregoing, the Mashpee Zoning Board of Appeals found that the
Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly
made and seconded, the Zoning Board of Appeals voted unanimously on July 9, 2008 to
grant the following: 8 foot variance on the southwesterly side and a 13.5 foot variance on
the northeasterly side.
Reference plans from John Doyle, Land Surveyor of Falmouth, MA., dated June
12, 2008.
