Mashpee Zoning
Board of Appeals Robert Dobson
2 V-08-37
the shed 10 feet off the lot line. Actually, the applicant would like it pushed 5 feet closer
to the lot line thus requesting a 10 foot variance on the side and a 5 foot variance in the
rear. Mr. Nelson mentions that the lot coverage is tight and asks whether or not the
engineer included the existing shed? Mr. Warburton says that everything is included.
The neighbors are fine with the shed since there are a lot of shrubs being planted. On the
plan, the actual shed will be moved closer to the lot line that what is shown. Mr. Nelson
says this is acceptable if Mr. Warburton signs the plans and shows exactly how far the
shed will be placed. Applicant is asking the shed to be 5 feet off the lot line instead of
the 10 feet they initially requested. Jonathan Furbush makes a motion to grant a 10 foot
variance on the northwesterly side and a 5 foot variance on the southwesterly side.
Robert Nelson seconds the motion.
GENERAL FINDINGS
1. that the subject property is located at 11 Squaws Lane and contains 8,550
square feet.
SPECIFIC FINDINGS
The Board determined that:
h. a literal enforcement of the By-laws would involve substantial hardship to
the petitioner.
2. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or
purpose of the by-law.
In view of the foregoing, the Mashpee Zoning Board of Appeals found that the
Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly
made and seconded, the Zoning Board of Appeals voted unanimously on August 13,
2008 to grant a 10 foot variance on the northwesterly side and a 5 foot variance on the
southerwesterly side.
Reference plans from Sweetser Engineering of South Dennis, MA., dated July 5,
2008 as amended by signature of applicant's representative, Brian Warburton.
