Mashpee Zoning
Board of Appeals Frank Silva(Foley Auto Repair)
3 SP-08-37
5) Septic System: Mr. Silva has increased the size of the soil
absorption system from 444 gpd to 599 gpd; 150 gpd would be
designated for Unit #5. The remaining 449 gallons would be
divided between the remaining 5 units on a pro-rated basis because
each unit varies in size. The work has been completed.
6) Parking Lot: Mr. Silva applied for a Special Permit modification
asking that he be given one year from the date of the permit issued
to install the topcoat and stripe the parking spaces.
7) A revised plot plan was submitted showing the relocation of the
handicapped parking spaces and the fenced-in dumpster.
The ZBA has informed both Mr. Silva and Mr. Beaulieu that the above
mentioned items are to be completed no later than December 31, 2009 or the
Special Permit for the entire building will be recinded. They have been
more than patient since 2004 for these items to be completed—there will be
no exceptions. The Board will move to grant the Special Permit for the
repair shop and for the modification of the special permit to Mr. Silva with
these measures in place. Both Mr. Silva and Mr. Beaulieu fully understand
the requirements and agree to have them completed by the implemented
date.
The permits are also contingent on Hazardous Waste approval from the Fire
Department.
Mr. Stevens informs the Board that he went to the site to inspect the fire
walls and found them to be in compliance. He also mentioned that it was
one of the neatest auto body shops around.
The Board asks Mr. Beaulieu if he has contracted with anyone for the oil
removal yet. He has made some phone calls but to date has not officially
hired anyone. He is presently not doing any oil changes.
