• <br />• <br />0 <br />Mashpee Zoning <br />Board of Appeals Minutes <br />1 August 13, 2008 <br />Zoning Board of Appeals <br />Minutes — Wednesday, August 13, 2008 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on <br />Wednesday, August 13, 2008 at the Mashpee Town Hall. Board <br />Members Robert Nelson, Jonathan Furbush, James Reiffarth, William <br />Blaisdell and Jack Dorsey were present. Alternate members Peter <br />Hinden and Zella Elizenberry were also present. <br />Chairman Robert Nelson opens the hearing at 7:00 p.m. Mr. Nelson welcomes <br />back Zella Elizenberry who has been out for quite sometime with some medical <br />problems. They are glad to have her back. <br />Jonathan Furbush reads the continuances. <br />Alex MacLellan: Seamist Builders - 403 Great Oak Road — Mr. MacLellan <br />would like to address the Board regarding the information he has acquired on his <br />lot. He has a letter from the ARC stating that the lot in question is in the Little <br />Neck Bay subdivision. <br />Mr. MacLellan was asked to attend this hearing informally to discuss the letter <br />from Frances Drew, ARC Administrator regarding 403 Great Oak Road and <br />whether or not a variance is required. Mr. MacLellan informed the Board that the <br />lot in question is included in the Little Neck Bay subdivision which is a cluster and <br />only requires 15,000 square feet for a buildable lot. Rich Stevens, Building <br />Commissioner accepts the letter as evidence that indeed the lot is buildable as is <br />and does not require a variance as the Board first believed. Bob Nelson <br />discusses this with Mr. Stevens and the Board. Mr. Stevens said the lot next <br />door at 397 Great Oak Road did not require a variance and is also inclusive in the <br />Little Neck Bay subdivision. Lots numbered 1-155 are covered under this deed <br />restriction called Little Neck Bay (Lot #154 (aka 403 Great Oak Road) and is <br />buildable without the need for a variance. <br />
